<p>The offence of driving without insurance is taken very seriously by the Magistrates Court due to the possible implications if you were to crash. </p>
<p>In order to be found guilty of driving without insurance, the Prosecutor only has to prove that you were driving the vehicle on a public road at the time in question and it is down to the defendant (you) to prove that you had insurance and you were allowed to be driving it. This is an unusually way of proceeding in court, but it is this way because it would be extremely time consuming and nearly impossible for the Prosecutor to prove that you were not insured because they would have to go to every insurance provider in the country and check that you aren&#8217;t insured with each of them. It is therefore your responsibility to prove that you did have insurance to be driving the vehicle at the time in question. </p>
<p>One of the most common ways in which people get caught out with the no insurance law is that they may not actually drive the car, but the law states that you only have to have use of the vehicle in order to be liable for punishment under the no insurance law. Having use of the vehicle can simply mean having the vehicle parked on a public road outside your house and if it is not insured, then you can be prosecuted. </p>
<p>Another common way in which people get accused of driving with no insurance, not believing that they have actually done so is when they believe that their fully comprehensive insurance policy means that they can drive anyone&#8217;s car with their permission. Many insurance policies do not actually state that this is allowed. </p>

<p>There are several things that you can do to reduce your caravan insurance, you can use proven security devices to disable the tow hitch in order to make it harder for your caravan to be stolen. You can also make sure that your caravan is stored within a locked compound as that will also help to protect it.</p>
<p>The price that you pay for your caravan insurance can vary a huge amount from company to company, so you will want to ask caravan insurance experts as they will be able to offer additional guidance on how to reduce your annual premiums. <p>Where you used to be able to use driving without due care and attention or a momentary lapse in concentration as something of an excuse for a driving offence, these themselves are now driving offences.</p>
<p>Organisations such as MADD (Mothers Against Drunk Driving) have been campaigning for such changes in the law for some time. Several areas of the country have different levels of punishment for this offence depending on the outcome of the careless driving in question.</p>
<p>What is surprising is that people dont really seem to take driving without due care and attention very seriously. In fact, people seem to side with the offenders and advise them on how to avoid their punishment. In an online forum we found one case where a man was charged for wheel-spinning his car on gravel by going very fast and kicking up lots of dust and gravel. The officer that charged him says in his report that there was a petrol pump nearby and it was open, and so could have caused a large accident and many potential injuries. The question he put on the forum was that if he could prove that the petrol pump was closed would that benefit his case in any way. And surprisingly, dozens of people replied with advice about how to get out of the charge and how to prove that something in the officers report was wrong!</p>
<p>Each year negligent driving is the cause of tens of thousands of people either being killed or seriously injured and we dont really take much notice of it. Thousands of people lose their driving licence each year (at least temporarily) because of careless driving and quite often they simply get back behind the wheel the next day without a valid licence. A lot of the time, the people living in the surrounding areas usually know when someone is doing this and dont pull them up on it, this is why we have a lot of the road accidents we have in the country.</p>
<p>Although as an offence, driving without due care and attention is not deemed as important as drunk driving or driving while talking on the phone, it is still one of the leading causes of road accidents and needs to be addressed with greater seriousness.</p>

			<content:encoded><![CDATA[<p>The North Carolina lemon law was created to protect consumers who purchase defective vehicles.  Due to the fact that manufacturers often denied any problems with the vehicles, consumers were left to do battle with multi-million dollar companies.  The North Carolina Legislature created the lemon law, which gives a private remedy against motor vehicle manufacturers for motor vehicles failing to conform to express warranty.</p>
<p>The North Carolina Lemon Law applies to cars that were purchased or leased in North Carolina.  The lemon law covers new cars, which ironically are cars that are sold as new.  The types of cars the lemon law covers are new passenger cars, pick-ups and motorcycles purchased in North Carolina.   The lemon law covers most vans as well.</p>
<p>Under the lemon law, the test to see if a vehicle is a lemon is to determine if the defects affect the use value or safety of the automobile. The legislatures goal was to give the consumer tools to better battle the automobile manufacturers and prevent them from summarily denying claims regarding problem vehicles.  One of these tools is a presumption that an automobile is a lemon.  To get a presumption that an automobile is a lemon, the purchaser of the automobile must show on of the two following are true:</p>
<p>The same problem or issue has been attempted to be repaired by the car manufacturer or a dealer greater than four (4) occasion and the problem continues to exist; or</p>
<p>The vehicle was out of service to the consumer during or while awaiting repair of the nonconformity or a series of nonconformities for a cumulative total of 20 or more business days during any 12-month period of the warranty. For the presumption to be effective, the North Carolina Lemon Law requires written notice of the non conformity be provided to the manufacturer before the lemon law can be triggered.  It is very important that you follow the written notice requirements of the law.</p>
<p>Under the North Carolina lemon law, a purchaser can get relief from a lemon vehicle in two ways. And the legislature has given the purchaser the option of which way they wish to be compensated. The lemon law requires the automobile manufacturer to give the purchaser a replacement auto of the same type or accept return of the purchasers automobile and give the purchaser their money back.</p>
<p>The refund to the consumer shall be reduced by a reasonable allowance for the consumer&#8217;s use of the vehicle. A reasonable allowance for use is that amount directly attributable to use by the consumer prior to his first report of the nonconformity to the manufacturer, its agent, or its authorized dealer, and during any subsequent period when the vehicle is not out of service because of repair. &#8220;Reasonable allowance&#8221; is presumed to be the cash price or the lease price, as the case may be, of the vehicle multiplied by a fraction having as its denominator 100,000 miles and its numerator the number of miles attributed to the consumer.</p>
<p>It is advisable that if you think your car is a lemon under the North Carolina lemon law, you should seek out a lemon law attorney now.  The North Carolina lemon law is favorable to consumers but still has several requirements that must be met or your case could be damaged. <p>Recently in Washington , a man had problems with a 2008 Lamborghini.  A car that he paid a quarter of a million dollars for.  One would think that a vehicle like that costs as much a s a house wouldnt have mechanical problems. The owner experienced numerous brake problems with the vehicle.   He was told by the dealer that the brakes needed time to wear in.  The brakes continued squealing and screeching so the owner took it back to the dealer.</p>
<p>With Lamborghini unable to fix the vehicle, the consumer could no longer tolerate the squeaky brakes and the dealership was unable to fix the car.  After many, many visits to the dealership, the vehicle still made noises.</p>
<p>With Lamborghini unable to fix the vehicle, the owner chose to pursue a Washington Lemon law case.   The case was set for arbitration and Lamborghini and the owner presented their cases.  The arbitrator ruled against Lamborghini.</p>
<p>It was a verdict for the consumer in the amount of $230,000.00.  Essentially the arbitrator returned the entire purchase price of the vehicle.</p>
<p>No matter how much you pay for a  pay for a car, a consumer cant always avoid being stuck with a defective car. It doesnt matter what you pay for a car, the Washington Lemon law still protects you stated the Attorney General.  </p>
